Type Bill
Session 2018 Regular Session
Subjects
Agriculture

Concerning modifications to the "Colorado Food and Drug Act" to allow products containing industrial hemp, and, in connection therewith, establishing that products containing industrial hemp are not adulterated or misbranded by virtue of containing industrial hemp.

Bill Summary:

Industrial hemp - use in food and cosmetics - not adulterated or misbranded. The act establishes that food and cosmetics are not adulterated or misbranded by virtue of containing industrial hemp. The act also sets forth the department of public health and environment's powers with regard to applicants and registrants engaged in, or attempting to engage in, the wholesale food selling, manufacturing, processing, or storage of an industrial hemp product, as that term is defined in the act. Finally, the act clarifies that it does not provide a basis upon which an entity with federal drug administration approval or its agent could seek to prevent or restrict the nonpharmaceutical production, sale, or distribution of naturally occurring cannabinoids or cannabinoid extracts.
