Amendments to the Uniform Community Property and Disposition Act - Draft finalized and ready for introduction

Ms. Connie Eyster, Colorado Bar Association, when asked to summarize the changes being made to the Colorado version of the act, shared that the changes clarified how real property that is community property will be treated at death.

Commissioner Snyder added that he met with the Colorado Bar Association and minimal changes were needed, they were simply replacing some uniform language that had been left out.

Commissioner Levy asked if a reason for the omission was found in the legislative history, draft versions, or drafting notes. Commissioner Love reponded that the omission was researched but there was no legislative history regarding it and there was nothing regarding it in any available drafting notes, it seems that it was just an oversight.

Commissioner McGihon noted that no motion was required as the bill was moved and approved for introduction at the December meeting. The commission thanked Ms. Eyster for her testimony.
